Its just amazing.
Is this what people want when they say judges should not be "activist"???
Say it ain't so

This is absolutely irresponsible of the courts to knowing allow a company to pollute and kill a lake.
Like most things one needs to read the full decision to understand what the court actually said... Relying on newspapers for facts is a fool's errand.
It is possible to agree with the court decision and still believe the junk should not be dumped in the lake...
I have read the permit issued in 2003 (I think the year is correct.) I don't have as much of a problem with the fish kill, that is justified all the time in my home state of Montana to control "undersireable" fish, but the ability to control and mitigate any devience from the reclaimation plan is where concerned citizens should focus their efforts. The ability does exist to mine and reclaim this 20 acre lake without hindering the ability of spawning activity, it just needs to be done and that does not come without effort. I have personally been involved with mining on several elevations underneath my favorite river and as minig continues today it is still as pristine as it was before the mines when I was a kid. It takes a partnership between concerned people and the company.
I should disclose I have personal friends of high intergrity on the ground at the mine. By the way, they are flyfishing partners of mine!
Guaranteed environmentalist BS.
Guaranteed.
Our local stream has been devastated by dam work by the state, killing a lot of trout.................and just where is the media???
But if 5 fish were killed by "run off" from a dirt bike trail the media would be all over it!!
